Minddex.ai Platform

Preamble
These Terms of Use (hereinafter the “TOU“) govern the access and use of the Minddex.ai platform (hereinafter the “Platform“), published and operated by KORTAIX SAS, a simplified joint-stock company with a capital of €1,000, registered with the Paris RCS under number 989 787 767, whose registered office is located at 56 avenue de Suffren, 75015 Paris (hereinafter “KORTAIX” or the “Publisher“).
Minddex.ai is an online service (Software as a Service) for strategic intelligence dedicated to analyzing brand visibility in responses generated by artificial intelligence (hereinafter “Generative Engine Optimization” or “GEO“). No software is delivered or installed on the Client’s infrastructure.
These TOU apply to any User accessing the Platform, regardless of the subscription method. When a Client has entered into a contract with KORTAIX including special conditions, these complement the present TOU and prevail in case of contradiction. By checking the box “I have read and accept the Terms of Use” during registration, the User acknowledges having read these TOU and accepting them without reservation.
Article 1 – Definitions
The following terms, when capitalized in these TOU, have the meanings assigned to them below:

| “User” | Any natural or legal person who has created an account and accesses the Platform. |
| “Account” | The personal space created by the User during registration, protected by login credentials. |
| “User Data” | All data, content, configurations, and parameters entered or imported by the User (brands, projects, queries, documents). |
| “Generated Content” | Analyses, scores, dashboards, recommendations, and results produced by the Platform based on the processing of User Data. |
| “Subscription” | The pricing plan chosen by the User giving access to the Platform’s features. |
| “GTC” | The General Terms of Choice/Sale governing the commercial and financial aspects of the Subscription, available on the Platform website. |
Article 2 – Purpose
The purpose of these TOU is to define the conditions under which KORTAIX makes the Platform available to the User, as well as the respective rights and obligations of the parties. The TOU are supplemented by the GTC, which govern pricing, billing, and payment terms. In case of contradiction between the TOU and the GTC, the GTC prevail over commercial aspects.
Article 3 – Access to the Service and User Account
3.1 Account Creation Access to the Platform requires the creation of an Account. The User agrees to provide accurate, up-to-date, and complete information during registration and to keep it updated. Each Account is strictly personal and cannot be shared or transferred.
3.2 Account Security The User is solely responsible for the confidentiality of their login credentials and for any activity performed from their Account. In case of suspected unauthorized use, the User agrees to inform KORTAIX immediately at privacy@minddex.ai. KORTAIX cannot be held responsible for any damage resulting from unauthorized access to the User’s Account due to the latter’s negligence in protecting their credentials.
3.3 Multi-user Accounts When the subscribed Subscription allows several users within the same organization, the main User (administrator) is responsible for managing access and ensuring compliance with these TOU by all users attached to their organization.
Article 4 – Authorized Use and Restrictions
4.1 Authorized Use The User agrees to use the Platform exclusively for legal and professional purposes, in accordance with its intended use.
4.2 Restrictions The following are strictly prohibited:
- Any attempt at massive or systematic data extraction (scraping, crawling), including via automated scripts, bots, or third-party tools;
- Reverse engineering, decompilation, or disassembly of all or part of the Platform;
- Using data, analyses, or results provided by the Platform to develop, market, or operate a product or service competing with Minddex;
- Resale, redistribution, or making Generated Content available to third parties, except within the framework of the User’s legitimate internal use;
- Performing benchmarks or comparative tests intended for publication without prior written authorization from KORTAIX;
- Using the Platform for defamatory, fraudulent purposes, or purposes contrary to public order;
- Circumventing or attempting to circumvent the technical protection measures of the Platform.
KORTAIX reserves the right to immediately suspend the access of any User in the event of a proven or suspected violation of these restrictions.
Article 5 – Intellectual Property
5.1 KORTAIX Rights The entire Platform, including without limitation its architecture, algorithms, source code, interfaces, dashboards, scores, recommendations, documentation, editorial content (notably the GEO Academy), trademarks, and logos, is protected by intellectual property law and is the exclusive property of KORTAIX. The User benefits from a limited, non-exclusive, non-transferable, and revocable right of access and use, for the duration of their Subscription, strictly for their internal professional use.
5.2 User Rights User Data imported or entered into the Platform remains the exclusive property of the User. KORTAIX acquires no ownership rights over this data.
5.3 Generated Content Generated Content produced by the Platform (analyses, scores, recommendations) is produced by KORTAIX’s proprietary algorithms. The User has a right to use this content within the framework of their internal professional activity. This right does not confer any intellectual property over the underlying algorithms, methods, or models.
Article 6 – Data and Confidentiality
6.1 Processing of User Data KORTAIX processes User Data solely to provide the subscribed services. KORTAIX undertakes:
- Never to sell User Data to third parties;
- Not to use User Data for commercial prospecting purposes on behalf of third parties;
- Not to communicate User Data to third parties, except under legal obligation or express authorization from the User.
6.2 Aggregated Data and Service Improvement KORTAIX may use anonymized and aggregated data, which does not allow the direct or indirect identification of a User or their brands, for the purpose of improving the Platform and its algorithms. This aggregated data is the property of KORTAIX.
6.3 AI Processing Architecture The Platform operates based on anonymous prompts sent to artificial intelligence engines. No personal data of the User is injected into queries addressed to AI providers. This architecture is detailed in the AI Analysis Note available upon request (reference NOTE-IA-2026-01).
6.4 Personal Data Protection (GDPR) KORTAIX processes the User’s personal data (login credentials, technical logs) in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act. Details are described in the Privacy Policy: https://minddex.ai/politique-de-confidentialite/. For any exercise of rights (access, rectification, deletion, portability, opposition), the User can send their request to: privacy@minddex.ai.
6.5 Portability and Export of User Data The User can at any time request the export of their User Data in a structured, commonly used, and machine-readable format (CSV or equivalent). The request is processed within a reasonable period not exceeding thirty (30) days.
6.6 Confidentiality Each party agrees to treat as confidential the non-public information of the other party. This obligation survives for two (2) years after the termination of the contractual relationship. Information is not considered confidential if it: (a) was publicly known; (b) became public without fault of the receiving party; (c) was legitimately received from a third party; (d) must be disclosed by law.
Article 7 – Subcontractors and Infrastructure
The Platform relies on third-party providers selected for their compliance and reliability. Main subcontractors intervene in: hosting, payment management, and provision of artificial intelligence models (LLMs). The updated list is available at privacy@minddex.ai. KORTAIX reserves the right to change subcontractors provided an equivalent level of protection is maintained. Significant changes will be notified to Users. Data transfers outside the European Economic Area are governed by appropriate safeguards. Regarding AI providers: only anonymous prompts are transmitted.
Article 8 – Availability, Service Levels, and Support
8.1 Availability Commitment KORTAIX agrees to deploy its best commercially reasonable efforts to maintain the Platform with a Monthly Availability Rate of at least 99.5%. Monthly Availability Rate = (Total duration of the month – Downtime) / Total duration of the month × 100. This is an obligation of reinforced means, not an obligation of result. Clients desiring higher commitments (99.9%+) should subscribe to an Enterprise offer (contact: sales@minddex.ai).
8.2 Planned Maintenance KORTAIX may temporarily interrupt access for maintenance. KORTAIX will endeavor to:
- Schedule maintenance outside business hours (10:00 PM to 6:00 AM, Paris time);
- Notify Users 48 hours in advance, except for emergencies. Planned maintenance shall not exceed eight (8) hours per calendar month.
8.3 Exclusions Exclusions from the Monthly Availability Rate calculation include downtime resulting from:
- Planned maintenance notified per article 8.2;
- Force majeure events;
- Failures of third-party providers (AI/LLMs, hosting, networks);
- User acts or omissions;
- Malfunctions of the User’s environment/internet.
8.4 Service Credits In case of failure to meet the Availability Objective, the User may request service credits:

Credits must be requested via support@minddex.ai within 15 days of the month’s end. They are credited to the next invoice and are the User’s sole remedy.
8.5 Technical Support Support is available via email (support@minddex.ai) Monday to Friday, 9:00 AM to 6:00 PM (Paris time), excluding French public holidays.

These are indicative targets, not firm contractual commitments for resolution.
Article 9 – Liability
9.1 Quality of Analyses Analyses are based on third-party AI engines and are indicative; they do not constitute strategic, legal, or commercial advice. The User remains solely responsible for decisions made based on Generated Content. KORTAIX does not guarantee accuracy or consistency due to the variable nature of AI.
9.2 Limitation of Liability KORTAIX’s total liability is capped at the amount paid by the User in the 12 months preceding the event. KORTAIX is not liable for indirect damages (loss of revenue, data, opportunity, image, profit).
9.3 Force Majeure KORTAIX is not liable for failures resulting from force majeure (per Article 1218 of the Civil Code), including AI provider changes, network failures, or cyberattacks. If force majeure exceeds 60 days, either party may terminate without indemnity.
9.4 Indemnification The User agrees to indemnify KORTAIX against third-party claims resulting from their use of the Platform in violation of these TOU.
Article 10 – Duration, Termination and Consequences
10.1 Duration The TOU take effect upon Account creation and remain in force for the duration of the Subscription. Subscriptions renew tacitly unless otherwise stated in the GTC.
10.2 Termination by User The User can terminate at any time via their account management space, effective at the end of the current period. No pro-rata refund will be issued.
10.3 Termination by KORTAIX KORTAIX may suspend or terminate access for TOU/GTC violations, fraudulent use, non-payment, or security risks.
10.4 Consequences of Termination Upon cessation: access is deactivated; User has 30 days to request data export. Data is deleted within 60 days thereafter. Technical logs are kept for 12 months.
10.5 Surviving Clauses Articles 5, 6.6, 9, 9.4, and 13 survive termination.
Article 11 – Modification of TOU
KORTAIX may modify these TOU. Substantial changes will be notified 30 days in advance. If refused, the User may terminate without penalty. Continued use implies acceptance.
Article 12 – Cookies and Trackers
The Platform uses cookies in accordance with CNIL recommendations. Users can manage preferences via the cookie banner. Details are in the Cookie Policy.
Article 13 – Applicable Law and Dispute Resolution
These TOU are governed by French law. Parties will seek an amicable solution within 30 days of a dispute. Failing this, exclusive jurisdiction is granted to the courts of Paris.
Article 14 – General Provisions
These TOU, GTC, and Privacy Policy constitute the entire agreement. If any provision is void, others remain in force. Failure to enforce a breach is not a waiver. KORTAIX may freely assign these TOU. Computer records serve as proof of communications.
